Alcohol Beverage
Our Alcohol Beverage Department provides a crucial and unique service to Northern California wineries, importers, restaurants, hotels and other businesses that must comply with the laws and regulations of the California Department of Alcoholic Beverage Control (ABC) and federal Alcohol and Tobacco Tax and Trade Bureau (TTB). As the wine industry has grown, legal issues associated with the production and sale of wine and other alcoholic beverages have proliferated. DP&F is one of the few firms in California that offers a depth and range of experience in meeting all local, state and federal requirements. In particular, our lawyers are skilled in helping our clients deal with multi-jurisdictional issues. We frequently provide an interface between land use regulators and state and federal departments to resolve the complicated and sometimes conflicting issues that arise when the three jurisdictions have overlapping authority. We handle such matters as ABC license transfers and new ABC license applications, ABC protest hearings and disciplinary proceedings, ATF basic permit applications, custom crush arrangements including alternating proprietorships, related California and federal record keeping, establishment of wine appellations, labeling matters, alcohol beverage franchise laws pertaining to distributor appointments and terminations and other alcohol beverage compliance matters. Our client list includes Anchor Brewing Company, Brix Restaurant, Cakebread Cellars, Celadon, Don Giovanni, Far Niente Winery, French Laundry, Harlan Estate Winery, the Napa Valley Vintners Association, Niebaum-Coppola Estate Winery, Pine Ridge Winery, Trefethen Vineyards, Turnbull Wine Cellars, and many of the other wineries and restaurants throughout the region and state.
