Dave Meyers spent more than 35 years practicing at Dickenson, Peatman & Fogarty, before retiring in 2008, but remains as Of Counsel to the firm. He is available to the firm on a consultancy basis. He previously chaired the litigation department and served as managing director for several terms. He has handled all types of land use matters, both administratively and judicially, as well as a broad variety of civil litigation matters, with extensive court and jury trial experience. He has emphasized issues of concern to the wine industry, landowners and commercial entities of all kinds.
Dave serves on several community charitable foundations or boards, teaches law school classes part time in litigation procedure and medical law, and is an avid cyclist and traveler.
Representative Matters
- Recovered substantial damages for negligence and breach of contract in the development of Napa Valley and Russian River Valley vineyards after both jury and court trials
- Successfully defended the first Proposition 65 toxic tort case to go to trial in California after a month trial.
- Obtained land use approvals for projects large and small, including multiple wineries, as well as vineyard residential, commercial, retail and industrial developments and uses before various administrative agencies
- Recovered a seven figure fraud award related to a shopping center development after a two week arbitration before three San Francisco attorney arbitrators
- Successfully defended the Whitbread Atlas Peak and Beringer Napa winery projects from environmental challenges in the Napa Superior Court and assisted with both appeals, which resulted in published Court of Appeal decisions clarifying the law under CEQA.
