ALLISON N. BERK

  • Allison earned her J.D. from the University of California, Berkeley, School of Law. She earned her B.A. in International Relations and African/African American Studies from the University of California, Davis.

    Prior to joining DP&F, Allison litigated antitrust and consumer cases. She also counseled business owners in transactional matters including commercial leases, contracts, business formation, and employment law.

    Allison is Chair of the Sonoma County Bar Association’s Intellectual Property and Business Law Section.

  • Inter Partes Judgment in Favor of Oakville Hills Cellar dba Dalla Valle Vineyards – In 2025, DP&F obtained a judgment in favor of Dalla Valle Vineyards before the USPTO Trademark Trial and Appeals Board (“TTAB”).  DP&F, on behalf of Dalla Valle Vineyards, owner of the mark MAYA for wine, opposed the trademark application for MAYELA for wine.  The TTAB ruled in Dalla Valle Vineyards’ favor finding the marks to be confusingly similar and refused registration of the MAYELA mark for wine. Oakville Hills Cellar, Inc. dba Dalla Valle Vineyards v. Peninsula Vinicultores, S.L., Opposition No. 91287178 (TTAB Aug. 4, 2025).

     Inter Partes Judgment in Favor of Twin Peaks Winery – In 2025, DP&F obtained a judgment in favor of Twin Peaks Winery before the USPTO Trademark Trial and Appeals Board (“TTAB”).  DP&F, on behalf of Twin Peaks Winery, owner of the mark POETRY for wine, opposed the trademark application for TASTE THE POETRY for vodka.  The TTAB ruled in Twin Peaks Winery’s favor finding the marks to be confusingly similar and refused registration of the TASTE THE POETRY mark for vodka. Twin Peaks Winery, Inc. v. Nocturnal Vodka, LLC, Opposition No. 91288135 (TTAB Sept. 11, 2025).
