Federal Enforcement Update: Can Again Kicked Down the Road
As we explained in our previous post, the Rohrabacher-Blumenauer Amendment protects against federal enforcement of the Controlled Substances Act with respect to medical cannabis in states that have legalized it. The Amendment has been included in spending bills since fiscal year 2015. That means every Congressional debate over a new spending bill has been a new threat to the Amendment’s protections.
For months, Congress has failed to pass a long-term spending bill. Instead, it has passed short-term “continuing resolutions” to maintain the status quo and keep the government running. On February 9, 2018, Congress did so again. This time, Congress funded the government through March 23, 2018.
This means that the Amendment survived another threat, but the high drama continues. Stay tuned for further developments…
