JOY DURAND

Joy earned her Bachelor of Science degree at Saint Mary’s College of California, her Master’s degree in Business Administration from Sonoma State University and her Juris Doctor degree from the University of San Francisco School of Law.
As a law student, Joy had the unique opportunity to work as an extern to the Honorable Ming Chin of the California Supreme Court, and as an intern in the office of the general counsel for the San Francisco Giants.
Joy began her legal career as a commercial litigation associate in the San Francisco office of Reed Smith, LLP. While there, her practice included all aspects of complex commercial litigation in both state and federal courts. In 2011, Joy opened her own law office providing comprehensive legal services for small businesses.
Born and raised in Santa Rosa, Joy is thrilled to be back in Sonoma County. An avid traveler and adventurer, she has found that there really is “no place like home.”

Inter Partes Judgment in Favor of Bureau National Interprofessionnel du Cognac (BNIC) – Following a successful appeal to the Federal Circuit, on remand, the USPTO Trademark Trial and Appeals Board (“TTAB”) granted the opposition filed by DP&F on behalf of BNIC and Institut National Des Appellations d’Origine (INAO), owners of the geographical certification mark COGNAC for brandy, against the mark COLOGNE & COGNAC and Design for audio and video recordings featuring music and artistic performances and entertainment in the nature of live performances by musical artists. The TTAB ruled that based on evidence of relatedness presented by the plaintiffs, and given the evidence of fame of the COGNAC mark, the marks were confusingly similar, and registration of the mark COLOGNE & COGNAC and Design was refused. BNIC and INAO v. Cologne & Cognac Entertainment, Opposition No. 91250532 (TTAB July 28, 2025).
Inter Partes Judgment in Favor of Lagunitas Brewing Company – In 2021, DP&F obtained a judgment in favor of Lagunitas Brewing Company before the USPTO Trademark Trial and Appeals Board (“TTAB”). DP&F, on behalf of Lagunitas Brewing Company, owner of the mark LAGUNITAS for ale, opposed the trademark application for LAGUNATIC for beer, clothing, and various household items. The TTAB ruled in Lagunitas Brewing Company’s favor finding the marks to be confusingly similar and refused registration of the LAGUNATIC mark for beer, clothing, and various household items. Lagunitas Brewing Company v. Deanna Fulton and Kunoor Chopra, Opposition No. 91254430(TTAB Dec. 14, 2021).

DP&F, on behalf of BNIC, owner of the geographical certification mark COGNAC for brandy, opposed the trademark application for COGNADOR for wines and spirits. The TTAB ruled in BNIC’s favor finding the marks to be confusingly similar and refused registration of the COGNADOR mark for wines and spirits. BNIC v. Enovation Brands, Inc., Opposition No. 91242020 (TTAB Mar. 13, 2020).
Inter Partes Judgment in Favor of Rebel Wine Co. LLC – In 2018, DP&F obtained a judgment in favor of Rebel Wine Co. LLC before the USPTO Trademark Trial and Appeals Board (“TTAB”). DP&F, on behalf of Rebel Wine Co. LLC, owner of the mark BANDIT for wine (now owned by Sutter Home Winery, Inc.), opposed the trademark application for MASKED BANDIT for beer. The TTAB ruled in Rebel Wine Co. LLC’s favor finding the marks to be confusingly similar and refused registration of the MASKED BANDIT mark for beer. Rebel Wine Co. LLC v. Piney River Brewing Co., Opposition No. 92063917 (TTAB May 25, 2018).
